Dan Thompson specializes in resolving concerns that clients may have with governmental regulatory matters, with a particular emphasis on environmental and land use issues. Matters can include licensing, permitting, enforcement, policy development, contracts and bid disputes, and can involve negotiation, administrative and civil litigation, rulemaking, appearances before legislative and administrative bodies, and such other activities as are necessary to resolve client problems. Mr. Thompson’s practice also includes general civil and appellate litigation. Some of the more extensive and complex matters handled by Mr. Thompson at Berger Singerman include federal court litigation over the scope of Clean Water Act permitting requirements associated with the water management activities of the South Florida Water Management District; administrative litigation over the issuance of environmental permits to the Florida Department of Transportation to widen 20 miles of U.S. 1 through wetlands in the Everglades and Florida Keys; an arbitration hearing, as arbitrator, over an application by Tampa Bay Water for environmental permits to construct a 1100 acre, 15 billion gallon reservoir in Hillsborough County; and rule development activities before the Florida Department of Environmental Protection (“DEP”) (including rule drafting, public hearing participation and rule challenge litigation) associated with the promulgation of a numeric phosphorus criterion for the Everglades.
Prior to joining Berger Singerman in 1995, Mr. Thompson served as Deputy Secretary of DEP. From 1982 through 1993, he served in various capacities with the former Florida Department of Environmental Regulation (“DER”), including Deputy General Counsel for Enforcement, General Counsel and Assistant Secretary. As Deputy Secretary of the DEP, Mr. Thompson directed its regulatory divisions and district offices, supervising approximately 1300 employees. While at DER and DEP, he was chief litigation and legislative strategist for the State of Florida’s response to the so-called “Everglades Lawsuit,” and he led negotiations that resulted in the 1991 Settlement Agreement and the 1993 Statement of Principles, as well as the Marjory Stoneman Douglas Everglades Protection Act (1991) and the Everglades Forever Act (1994).
Mr. Thompson received his undergraduate degree from Yale University in 1970, and his law degree, with honors, from Florida State University College of Law in 1974. He is a member of The Florida Bar, and is admitted to practice in all United States District Courts in Florida, the United States Eleventh Circuit Court of Appeals and the United States Court of Claims. He has served as an Adjunct Professor of Law at the Florida State University College of Law, was formerly a member of the Executive Council of the Environmental and Land Use Law Section of The Florida Bar, and has spoken at numerous seminars offered by The Florida Bar, the American Bar Association, the Florida Chamber of Commerce, and various professional, trade and other organizations. He is a co-author of the Treatise on Florida Environmental and Land Use Law (The Florida Bar, 2005), Chapter 9 (Wetlands and Surface Waters) and Chapter 11 (Groundwater). He is currently President of the Board of Trustees of the Apalachee Land Conservancy, a member of the Board of Directors of Florida Legal Services, Inc., and Tallahassee Area Director of the Yale Alumni Schools Committee. Recent other community leadership positions have included Co-chair the Refuge House Capital Campaign and President of the Legal Aid Foundation of the Tallahassee Bar Association. Mr. Thompson is rated "A-V" by Martindale-Hubbell, is a listed attorney in Florida Trend's Florida Legal Elite, Florida Super Lawyers and Chambers USA, America’s Leading Business Lawyers.
