Through the decisions of the Information Technologies and Communication Authority, published in the Official Gazette dated 19.01.2021 and numbered 31369, placing advertisements on social network providers Twitter, Pinterest and Periscope/Scope has been banned.
Under the Law No. 7253 Amending the Law on Regulation of Publications on the Internet and Suppression of Crimes Committed by Means of Such Publications, which entered into force on 01.10.2020, the obligation to appoint and notify a representative has been introduced to the foreign social network providers having a daily access of over one million users.
In this context, giving a new advertisement and making money transfer by real and legal persons, who are resident taxpayers in Turkey to social network providers named Twitter, Pinterest, and Periscope/Scope, who have not fulfilled the obligation to appoint and notify a representative, have been banned.
In terms of tax law, the most significant result of the decisions is that the relevant advertising costs cannot be deducted from the corporate tax base. In other words, until a new decision is taken as of 19.01.2021, it may be claimed that the advertising costs of the taxpayers spent with the banned social network providers could not be written as expenditure.
