Extending the Period of Justified Absences

Law no. 1/2022, of 3 January, extends the period of justified absences to 20 days in the event of the death of a descendant or relative in the first degree of the direct line, or up to five consecutive days in the event of the death of a spouse not separated from people and property or of a relative in the first degree of the direct line, including anyone living in a non-marital partnership or common economy with the worker, amending the Labour Code.

It also establishes the right to psychological support in situations of the death of descendants or first-degree relatives in the direct line, where both parents have the right to request psychological support from the attending physician at a National Health Service establishment, which must begin within five days of the death. This right is also guaranteed in the event of the death of close relatives, namely spouse and ascendants.

Law 1/2022 comes into effect on 4 January 2022.
