Burness Paull (Scotland) has continued its run of success for client Sky, by securing a pay out of over £73,000 to cover damages, fines and court expenses – the largest award ever made against a pub landlord in actions of this kind.
The figure was awarded by the Intellectual Property (IP) Court in Scotland following its ruling in February 2014 that the Premise Licences Holder (PLH) and the Designated Premises Manager (DPM) of the Avalon Bar in Glasgow had been in breach of Sky's copyright law showing sporting events at the venue without the required commercial licence.
Sky were also awarded an "additional fee" which increased the overall amount of costs which have to be paid by the PLH and DPM. An additional fee was awarded partly to acknowledge the seriousness of the infringement and the significance of the case to Sky. The award sends a clear message to pub landlords across the country that there will be significant consequences should they chose to show such events in their premises without the appropriate licence.
